SPS Mark Syphus admits they electronically sign employees signatures & stumbles to address chain of assignment.
SPS employee Diane Weinberger wore a second hat and offered to represent Wells Fargo in their deposition. Our lawyer flew all the way out to Salt Lake City, Utah. Ms. Weinberger also signs lots of court documents stating she has reviewed the records personally herself and all the documents are in order for the sole purpose of foreclosure.
Elizabeth Campbell, Locke Lord's partner attorney (Atlanta & West Palm), asking homeowner questions for over six hours so they can use testimony to file a summary judgement after discovery period has ended.
SPS Mark Syphus 02/02/2017 deposition. Homeowner flew out to Salt Lake City, Utah and watched his attorney ask some real tough questions that Mr. Syphus seemed a bit confused and had a very hard time trying to answer.
Elizabeth Campbell, Locke Lord Senior Partner attorney, deposing homeowner for over 6 hours again. If you read through the deposition you will see the friction aimed towards the homeowner and my attorney had to object almost the entire time for her tone and being belligerent. But the most unusual thing Liz went and got a security guard at the Georgia State Bar and had him sit in homeowner deposition because she feared for her safety.
Homeowner's always hear about how they like to play the shell game, so in my case when we tried to a scheduled a deposition against US Bank around 6/2015 as the Custodian - they claimed SPS the month prior asked for the original custodial files for the entire SASCO 2007-MLN1 trust, so US Bank stated they shipped all the orginal custodial files to Select Portfolio Servicing. So how can a Trust not have a Custodian anymore or did SPS expand it's role as a servicer?
